Special Alert—COVID-19 and Workers’ Compensation Litigation Update for Florida
Many businesses in Florida have now reopened with social distancing guidelines in effect. As for ongoing litigation for workers’ compensation claims in the state, Deputy Chief Judge David Langham indicated that the prior Department of Administrative Hearings Memorandum, AODOAH20-05 expired on May 31, 2020. This order had mandated that all state mediations and hearings be held via telephone or videoconference. Telephonic appearance for mediations and hearings may still be available, but must now be requested on a case-by-case basis through the properly assigned judge or state mediator. Some mediators and judges continue to work remotely based upon individual needs for increased social distancing.
