What's Hot in Workers' Comp - Special PA Alert*

As the result of the COVID-19 pandemic, Pennsylvania Governor Tom Wolf issued a Disaster Declaration which suspended Section 449 of the Pennsylvania Workers’ Compensation Act requiring the attestation of the claimant's signature on a Compromise & Release Agreement by two witnesses or by a notary public. That Disaster Declaration will expire on September 30, 2021. As of October 1, 2021, parties will be required to comply with Section 449 in full by obtaining either two witness attestations or notarization of the claimant's signature on a C&R Agreement. Without the required witness signatures or notarization after October 1, 2021, the C&R could be considered invalid.
