General Contractor for Hospital Addition Prevails in Construction Defect Action.

We obtained summary judgment in a construction defect case that was argued before the U.S. District Court for the District of Maryland. The case involved a claim that our client, the general contractor for an addition to a hospital, had committed numerous construction deficiencies during the construction of the addition and had committed fraud in attempting to conceal those deficiencies from the hospital’s owner. The court agreed that our client did not commit fraud, and hence, the suit was barred by the accrual clause in the contract, which stated that the statute of limitations began to run upon substantial completion of the work. The settlement demand prior to the argument of the motion was $1.8 million – and we had offered $10,000.
